These terms and conditions (the "Disclaimer") govern the use of Agape Therapeutic (the “Site”). This Site is an informational and e-commerce website and is owned and operated by Kent Smith.

All content published and made available on this Site is the property of Agape Therapeutic and the Site’s creators. This includes, but is not limited to images, text, logos, documents, services, consultations, e-books, videos, blog posts, e-newsletters, e-mails, social media, and anything that contributes to the composition of this Site.

Age Restrictions

The minimum age to use this Site is 18 years old. By using this Site, users agree that they are over 18 years old. For minors, a properly executed written waiver of liability shall be obtained from the parents or legal guardians of any participant under the age of eighteen (18) years old. We do not assume any legal responsibility for false statements about age.

Acceptable Use

As a user of this Site, you agree to use this Site legally and to not:

  • Violate the intellectual property rights of the Site owners or any third party to the Site

If I believe you are using this Site illegally or in a manner that violates these Terms and Conditions, I reserve the right to limit, suspend or end your access to this Site. I also reserve the right to take any legal steps necessary to prevent you from accessing this Site.

Services Offered

  • Online quiz with free resources

  • A free, 90-minute vision and strategy session

  • The full container-a four-month program of sessions

  • The intensive container-a one-month program of sessions

  • A focused session-a single two-hour session

These Terms and Conditions apply to all the services that are displayed on this Site at the time you access it. All information, descriptions, or images about these services are as accurate as possible. However, I’m not legally bound by such information, descriptions, or images, as I cannot guarantee the accuracy of all provided services. You agree to purchase services from this Site at your own risk.

I reserve the right to change, reject, or cancel your order whenever it becomes necessary. If I cancel your order and have already processed your payment, I will give you a refund equal to the amount you paid. You agree it is your responsibility to monitor your payment instrument to verify receipt of any refund.

Third Party Goods and Services

This Site may offer goods and services from third parties. I cannot guarantee the quality or accuracy of goods and services made available by third parties on this Site. Our current third-party offerings include:

Service Delivery Process

The website quiz leads to:

  • The free guide-leads to ongoing self-practice or to a vision and strategy session

  • The Vision and Strategy Session–leads to ongoing self-practice or to one of the premium services below

Premium Services

  • The Full Container (energy medicine/wellness coaching)-the one-month program with active session support throughout the three-month implementation of your personal strategic action plan

  • The Intensive Container (energy medicine/wellness coaching)-the one-month program with self-directed support throughout the three-month implementation of your personal strategic action plan

  • A Focused Session (energy medicine)-a single, two-hour session

Payments

  • The preferred payment method for Canadian clients is e-transfer or PayPal for credit cards

  • International clients pay in USD via PayPal or Stripe

  • Cash (In-person sessions only)

When you provide your payment information, you allow me to charge the determined payment amount to this payment instrument.

If I believe your payment has violated any law or these Terms and Conditions, I reserve the right to cancel or reverse your transaction.

Seheduling Policies and Availability

  • Vision and strategy sessions are scheduled through the links provided on the quiz results pages

  • Follow-up sessions are scheduled via email or text

  • Virtual sessions are available on all scheduled working days

  • In-person sessions are available Tuesdays and Thursdays only

3-Day Cancellation and Refund Policy

We value your commitment to your wellness journey and want to ensure you are completely satisfied with your investment in our services. Our refund policy is designed to be fair and transparent while maintaining the integrity of our service offerings. This policy applies to the following services:

  • The Full Container (energy medicine/wellness coaching)

  • The Intensive Container (energy medicine/wellness coaching)

The following situations are not eligible for refund:

  • Services that have already been delivered or partially delivered

  • Requests made after the 3-day period

The Refund Process

To request a refund:

  • Submit your request in writing within the 3-day period

  • Include your full name, service purchased, purchase date, and reason for the refund

  • Refunds will be processed within 5 business days of approval

  • The refund will be issued to the original payment method

Provincial Consumer Protection Law

This refund policy complies with Canadian consumer protection laws and regulations. The policy is designed to provide fair terms while protecting both the client and practitioner’s interests. Your rights under the Business Practices and Consumer Protection Act remain unaffected.

Limitation of Liability

Agape Therapeutic Health Services and its directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, and expenses, including legal fees from your use of the Site.

Indemnity

Except where prohibited by law, by using this Site you indemnify and hold harmless Agape Therapeutic Health Services and its directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities, and expenses including legal fees arising out of your use of this Site or your violation of these Terms and Conditions.

Applicable Law

The laws of the Province of British Columbia govern these Terms and Conditions.

I believe this Site provides information in a straightforward and factual manner. You acknowledge you are taking part voluntarily in using this Site and that you are solely and personally responsible for your choices, actions, and results, now and in the future. You accept full responsibility for the consequences of your use, or non-use, of any information provided on or through this Site, and you agree to use your own judgment and due diligence before implementing any idea, suggestion, or recommendation from this Site to your life, family, or business.

No Guarantees

My role is to support and assist you in reaching your own goals, but your success depends primarily on your own effort, motivation, commitment, and follow-through. I can not predict or guarantee that you will attain a particular result, and you accept and understand that results differ from person to person. Results depend upon the unique background, dedication, desire, motivation, actions, and many other factors for every individual. You fully agree that there are no guarantees as to the specific outcome or results you can expect from using the information and/or services you receive through this Site.

Not Medical, Mental Health, or Religious Advice

I am not, nor am I holding myself out to be a doctor/physician, nurse, physician’s assistant, advance practice nurse, or any other medical professional (“Medical Provider”), psychiatrist, psychologist, therapist, counselor, or social worker (“Mental Health Provider”), registered dietitian or licensed nutritionist, or member of the clergy. As a wellness coach and energy medicine practitioner, I am not providing health care, medical, or nutritional therapy services, or attempting to diagnose, treat, prevent, or cure any physical, mental or emotional issue, disease, or condition. The information provided in or through this Site does not intend to replace the professional medical advice, diagnosis, or treatment provided by your own Medical Provider or Mental Health Provider.

You agree and acknowledge that I am not providing medical advice, mental health advice, or religious advice. Always seek the advice of your own Medical Provider and/or Mental Health Provider regarding questions you have about your specific health or any medications, herbs, or supplements you are currently taking and before implementing any recommendations or suggestions from services offered through this Site. Do not disregard medical advice or delay seeking medical advice because of information you have read on this Site. It is your responsibility to determine if these affiliate programs, products and/or services are appropriate for you personally. You are assuming all risks, and you agree that Kent Smith and/or Agape Therapeutic Health Services is not liable for any of the affiliate programs, products and/or services listed or appearing on this Site.

The testimonials, examples, and photos used are of actual clients and results they achieved, or they are comments from individuals who can speak to my character and/or the quality of my work. Severability

If at any time any of the provisions set forth in these Terms and Conditions are inconsistent or invalid under applicable laws, we will deem those provisions void and remove them from these Terms and Conditions. The removal of those provisions will not affect the validity of all other provisions, and the rest of these Terms and Conditions will still be valid.
